Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the websites, applications, services and mobile applications (the "Service") operated by Immigration Apps ("us", "we", "our" ).

By accessing or using the Service you agree to be bound by these Terms, whether or not you have created an account. If you disagree with any part of the terms then you do not have permission to access the Service.

Immigration Apps is not a law firm. No information provided by Immigration Apps shall be construed as legal advice.

Accounts

When you create an account with us or use our Service without creating an account, you represent and warrant that you are 18 or older, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.

Collected Data And Information On The Service

When you use the Service, we collect information from you that could identify you, such as your name and likeness, email address, and/or mailing address (“Personal Information”). You agree to the processing, use, storage and disclosure of your Personal Information by Immigration Apps, as described in this Terms of Service and our Privacy Policy accessible at Privacy Policy (the “Privacy Policy”) (“Data”). The Data will be used to provide and improve the Service, as well as to identify and communicate with you, and to respond to your requests/inquiries. We recommend that you read the Terms carefully.

Part of the information our Service displays may contain both Immigration Apps-created content and content that is not created or developed by Immigration Apps, related to the legal process for you and your case (the "Legal Information"). We may review third party-content to determine whether it is illegal or violates our policies, and we may remove or refuse to display content that we find violates our policies or the law. But we do not routinely screen third-party content that is published via our Service. This includes the Legal Information that lawyers post on Immigration Apps, and we cannot guarantee the accuracy, adequacy or quality of any such Legal Information, or the qualifications of those posting it.

Disclaimer of Warranties

You acknowledge that Immigration Apps is not responsible for (i) the accuracy, reliability, timeliness, or completeness of any information or data provided through the Service, (ii) the results that may be obtained from the use of the Service, or (iii) the provision of your legal services. Your use of the Service is at your sole risk.

Some jurisdictions do not allow the exclusion of certain warranties, so the limitations above may not apply to you.

Limitation Of Liability

In no event shall Immigration Apps nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of Immigration Apps and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Immigration Apps.

You agree that you will not, and will not allow any third party to, (i) copy, sell, license, distribute, transfers, modify, adapt, or prepare derivative works from, code from code from the Application or content that may be presented or content that may be presented or accessed through the Service for any purpose, unless otherwise permitted, (ii) take any action to circumvent or defeat the security or content usage rules provided, deployed or enforced by any functionality contained in the Application, (iii) use the Application to access, copy, transfer, transcode or retransmit content in violation of any law or third party rights, or (iv) remove, obscure, or alter Immigration Apps’s or any third party’s copyright notices, trademarks, or other proprietary rights notices affixed to or contained within or accessed in conjunction with or through the Service.

You may provide content to Immigration Apps for use by Immigration Apps and/or other users in connection with the Service (“User Content”). You represent and warrant that you will use your best efforts to ensure that User Content is accurate and that User Content does not violate the intellectual property rights, including copyrights, of others. You retain all rights in, and are solely responsible for, User Content. You give Immigration Apps, our affiliates, providers of third party services, and subcontractors a non-exclusive, fully-paid, perpetual, royalty-free, transferable, revocable, worldwide license to (i) use, modify, publicly perform, publicly display, reproduce, and distribute the User Content and (ii) use and exploit your name, nickname, pseudonym, initials, biography, likeness, trademarks, image or facsimile image, profile and other information provided by you to Immigration Apps, subject to the Privacy Policy (the “Content License”).

Links To Other Web Sites Or Mobile App

Our Service may contain links to third party web or mobile services that are not owned or controlled by Immigration Apps.

Immigration Apps has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party services. We do not warrant the offerings of any of these entities/individuals or their web or mobile services.

You acknowledge and agree that Immigration Apps shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third party web/mobile services.

We strongly advise you to read the terms and conditions and privacy policies of any third party web/mobile services that you visit.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you can click on the Delete Account button in the app and the termination will be performed automatically. Or you may send us an email at contact@InmigracionApps.com and express your request. We will then perform the termination process.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Indemnification

You agree to defend, indemnify and hold harmless Immigration Apps and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, b) a breach of these Terms; and/or c) any intellectual property infringement claim or breach privacy claim arising out of content or materials you provide to Immigration Apps through the Service.

Assignment

You may not assign this Agreement, and/or any of its rights and obligations hereunder, without the prior written consent of Immigration Apps. This Agreement is binding upon and inures to the benefit of the parties hereto and their respective successors and permitted assigns.

Governing Law; Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of New Jersey, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between you and Immigration Apps regarding the Service.

Any dispute arising out of or related to this Agreement that cannot be resolved by informal and good faith negotiations between the parties, shall be settled by final and binding arbitration to be conducted by a single arbitrator in Bergen County, New Jersey, pursuant to the rules of the American Arbitration Association. The decision or award of the arbitrator shall be final, and judgment upon such decision or award may be entered in any competent court or application may be made to any competent court for judicial acceptance of such decision or award and an order of enforcement. The parties agree that the arbitrator shall have the authority to impose equitable and injunctive relief as well as to award monetary relief, as the arbitrator deems appropriate.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is materialized we will notify you by, for example, sending a message to your account email. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
